1. Acceptance of Terms

By accessing, downloading, or using Haya Connect ("the App", "the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not use the Service. Your continued use of the Service constitutes your ongoing acceptance of these Terms and any modifications thereto.

2. Description of Service

Haya Connect is a Muslim matrimonial platform designed to facilitate introductions between Muslim individuals seeking marriage in accordance with Islamic principles. The Service operates as a technology platform only and does not act as a matchmaker, marriage broker, or Islamic advisor. We do not guarantee any particular outcome including marriage.

3. Eligibility

• You must be at least 18 years of age
• You must be legally permitted to marry in your jurisdiction
• You must provide accurate and truthful information during registration
• You may only maintain one active account
• You must not be currently married unless seeking a second wife (polygyny) and have disclosed this truthfully on your profile
• You must not be prohibited from using the Service under applicable law

4. User Conduct & Prohibited Activities

You agree NOT to:

• Provide false, misleading, or inaccurate information about yourself
• Impersonate any person or entity
• Harass, abuse, intimidate, or threaten other users
• Send unsolicited messages or spam
• Solicit money, financial information, or gifts from other users
• Use the Service for any commercial purpose without express written consent
• Attempt to circumvent any security features or access controls
• Reverse engineer, decompile, or disassemble the Service
• Upload malicious code, viruses, or disruptive software
• Scrape, crawl, or extract data from the Service
• Use the Service to engage in any illegal or fraudulent activity
• Share another user's personal information without their consent

5. Content & Intellectual Property

You retain ownership of content you submit to the Service. By submitting content, you grant Haya Connect a worldwide, non-exclusive, royalty-free license to use, display, and process such content solely for the purpose of operating the Service. All trademarks, logos, and Service content not submitted by users are the exclusive property of Haya Connect and may not be used without express written permission.

6. Photo & Identity Verification

For verification purposes, we collect facial images and optionally government-issued ID documents. These are reviewed by gender-matched human moderators (sisters review sisters, brothers review brothers) and are deleted immediately after verification is complete. We do not store biometric data beyond what is necessary for verification. By submitting verification materials, you consent to this processing.

7. Subscription & Payments

Certain features require a paid subscription. All payments are processed by third-party payment processors. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are provided at our discretion in accordance with applicable consumer protection laws. We reserve the right to modify subscription pricing with reasonable notice.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. HAYA CONNECT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON USERS AND MAKE NO REPRESENTATIONS ABOUT USER CHARACTER OR INTENTIONS. YOU USE THE SERVICE AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAYA CONNECT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Safety Disclaimer

Haya Connect strongly recommends that users exercise caution when interacting with individuals online. When meeting in person for the first time, always do so in a public place, inform a trusted person of your plans, and follow appropriate Islamic etiquette including mahram accompaniment as applicable. Haya Connect is not responsible for any harm arising from in-person meetings arranged through the Service.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time through the Settings page. Upon termination, your profile data will be deleted in accordance with our Privacy Policy and applicable data retention laws.

12. Governing Law & Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. CLASS ACTION WAIVERS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use after notice constitutes acceptance of updated Terms.
